DECISION ON MOTION
Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing (Exhibit #1) dated August 3, 2011.
College Counsel informed the Committee that the College recently confirmed that the Member passed away on April 23 , 2013. The Committee accepted the joint submission by counsel that the Member is deceased.
Having considered the submissions made by College Counsel and Counsel for the Member, the Committee authorizes the College to withdraw the allegations of professional misconduct against Thomas Edward Stretton set out in the Notice of Hearing (Exhibit # 1) dated August 3, 2011.
The Notice of Hearing (Exhibit # 1) will be endorsed as follows:
“Notice of Hearing withdrawn at the request of College with the permission of the Committee on May 24, 2013.”
The withdrawal of the allegations is appropriate as the Member is deceased. The Committee is satisfied that the withdrawal of the allegations is not contrary to the public interest.
