DECISION AND ORDER
Counsel for the College brought a motion to seek leave from the Discipline Committee to withdraw the allegations set out in the Notice of Hearing dated December 4, 2008.
Dominique Rocque was not in attendance at the hearing nor did he have legal representation.
Having considered the submissions of College Counsel, and upon the consent of the parties, the Committee authorizes the College to withdraw Dominique Henri Lucien Rocque’s Notice of Hearing and to withdraw the allegations of professional misconduct against him as set out in the Notice of Hearing dated December 4, 2008 in accordance with sub-rule 13.13(2) of the Rules of Procedure of the Discipline Committee and of the Fitness to Practise Committee, which came into effect in October 2011, against the following undertaking by the Member. The Member undertakes to:
resign as a member of the Ontario College of Teachers, effective immediately.
never seek reinstatement of his Certificate of Qualification and Registration and never teach again in a public or private school in Ontario.
acknowledge that his status on the Register of the Ontario College of Teachers is to read “Cancelled – Resigned” with the following notation:
Resigned on November 12, 2012 while he was the subject of disciplinary proceedings. Cancellation of Certificate of Qualification and Registration. Undertaking to refrain from teaching ever again in a public or private school in Ontario and never to seek reinstatement of his Certificate.
The Member acknowledges that should he fail to abide by this agreement and these undertakings, the College may then reinstate these proceedings.
The Committee finds that in this instance, the withdrawal of the Notice of Hearing against an Undertaking in these circumstances is reasonable and protects the public interest.
