DECISION AND ORDER
Counsel for the College brought a motion to seek leave from the Discipline Committee to withdraw the allegations set out in the Notice of Hearing dated December 4, 2008.
Judith Suzanne Chevalier was not in attendance.
The Committee reviewed the submissions of College counsel, in the presence of the Member’s counsel, who indicated that the allegations set out in the Notice of Hearing concerned the Member’s incompetence and professional misconduct based on three unsatisfactory Teacher Performance Appraisals. Since the filing of the allegations, the Member had addressed her deficiencies by completing a course and the Member’s most recent Teacher Performance Appraisal was satisfactory.
Upon the consent of the parties, the Committee authorizes the College to withdraw Judith Suzanne Chevalier’s Notice of Hearing and to withdraw the allegations of professional misconduct and incompetence against her as set out in the Notice of Hearing dated
December 4, 2008.
The Committee finds that in this instance, the withdrawal of the Notice of Hearing in these circumstances is reasonable and protects the public interest.
