Decision and Reasons for Decision
Counsel for the College brought a motion to seek leave from the Discipline Committee to withdraw the allegations set out in the Notice of Hearing dated April 17, 2008.
The Member, Joseph J. Mayrand, was not in attendance at the hearing.
The Committee reviewed the facts submitted by counsel for the College, including insufficiency of evidence. Upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct against Joseph J. Pierre Gaston Mayrand set out in the Notice of Hearing dated April 17, 2008, in exchange for the following Undertaking and Acknowledgement by the Member. The Member undertakes to complete the following no later than thirty (30) days before accepting a teaching position requiring a Certificate of Qualification and Registration issued by the Ontario College of Teachers:
(a) Immediately notify the Registrar in writing and, at the same time, send the name and address of his employer;
(b) Send directly to the Registrar an attestation stating that, during the six-month period preceding this agreement, he has successfully completed a course of instruction, pre-approved by the Registrar, focusing on classroom management and centred on sensitization to ethnocultural groups.
The Committee concludes that, in this case, the withdrawal of the Notice of Hearing in these circumstances in exchange for an Undertaking and Acknowledgement is reasonable and serves the public interest.
