DECISION ON MOTION
Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing dated October 18, 2006.
Joanne Mader was in attendance via teleconference.
Having considered the submissions of College Counsel and the Member, and upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct and incompetence against Joanne Mader set out in the Notice of Hearing dated October 18, 2006.
All allegations against this Member were based on three unsatisfactory Teacher Performance Appraisals. In the beginning of this hearing the College Counsel asked to withdraw the Notice of Hearing and indicated they have no intention of proceeding with this matter. In addition, College Counsel submitted to the Panel that since the Notice of Hearing, the Member has completed four courses related to:
a) Differentiated Instruction Sample Strategies
b) A course in Classroom Management Techniques
c) How to Survive and Thrive in teaching
d) Special Education Course
College Counsel indicated that the Member is a Special Education Resource teacher and has received two positive Teacher Performance Appraisals.
During this hearing held by teleconference call, the Member, after an explanation of the process given by the Committee’s Independent Legal Counsel, expressed no opposition to the withdrawal of the Notice of Hearing.
Having considered the submissions of College Counsel and the Member, and upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct and incompetence against Joanne Mader set out in the Notice of Hearing dated October 18, 2006.
