DECISION ON MOTION

Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing dated August 13, 2009.

Sarah Danielle Jellema was not in attendance but did provide a letter consenting to the withdrawal of the allegations in the Notice of Hearing.

The Committee was advised that the students and witnesses involved in the alleged incident indicated that they were unwilling to appear as witnesses and would not co-operate with College Counsel. There were conflicting reports as to whether the incident had actually occurred and who had been involved. One of the parents even suggested that the incident was a product of the students’ imagination. College Counsel indicated that the College could not meet its burden of proof and therefore was seeking permission to withdraw the allegations as there was no prospect of a finding of professional misconduct.

Having considered the submissions of College Counsel, and upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct against Sarah Danielle Jellema set out in the Notice of Hearing dated August 13, 2009.
