DECISION ON MOTION
Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing dated April 6, 2009.
Aubrey Roger Passmore was not in attendance.
The Committee considered the submissions of College counsel and Counsel for the Member. Upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct against Aubrey Roger Passmore set out in the Notice of Hearing dated April 6, 2009 in exchange for the resignation and Undertaking and Acknowledgement of the Member as follows:
The Member will, immediately following the withdrawal of the Notice of Hearing, resign his membership in the Ontario College of Teachers and the Registrar will cancel his Certificate of Qualification and Registration.
The Member undertakes that he will never seek reinstatement of his Certificate of Qualification and Registration and will never teach in any public school in Ontario.
The Member agreed to never volunteer at a school where the complainant might be employed.
The Member understands that any breach of any aspect of this Undertaking and Acknowledgement would constitute professional misconduct.
The Committee was advised that the complainant has accepted these undertakings as being an appropriate resolution.
The undertakings of the Member as listed above satisfied the Committee that the withdrawal of
the Notice of Hearing in exchange for the Member’s resignation and Undertaking and Acknowledgment in these circumstances is reasonable.
