REASONS FOR DECISION AND DECISION ON MOTION
Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Amended Notice of Hearing dated December 7, 2005.
John Philip Morris was not in attendance.
The Committee considered the submissions of College counsel. Upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct and incompetence against John Philip Morris as set out in the Amended Notice of Hearing dated December 7, 2005.
College counsel advised the Committee that the Member had resigned his membership in the College on September 12, 2006, that he had been the subject of a prior discipline hearing and had been found guilty of professional misconduct. Further, the Member has undertaken never to teach or to seek reinstatement of his Certificate of Qualification and Registration. These facts are available to the public as they are posted on the Public Register of the College.
Given that this Member will not teach again and that his name has been published, the Committee concludes that the withdrawal of the Amended Notice of Hearing is reasonable and it serves and protects the public interest.
