REASONS FOR DECISION AND DECISION ON MOTION
Counsel for the College brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing dated August 21, 2006.
Based on College Counsel’s assertion that the College would not be able to prove that the allegations occurred based on the burden of proof required, and the submissions of counsel for the Member, and upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct against Eula Lee Anderson set out in the Notice of Hearing, dated August 21, 2006.
The Committee notes for the record that the Member has retired and has signed an undertaking to not seek employment for which a Certificate of Qualification and Registration is required.
The Committee concludes that the withdrawal of the Notice of Hearing in these circumstances is in the public interest.
