REASONS FOR DECISION AND DECISION ON MOTION
Counsel for the College and Counsel for the Member brought a motion to seek leave from the Committee to withdraw the allegations set out in the Notice of Hearing dated December 18, 2003.
The parties consented that Bernard J. Adam, who had conducted a pre-hearing in this matter, be part of the Committee hearing the motion.
Independent legal counsel advised the Committee that the Committee had jurisdiction to make the order requested, pursuant to section 4.1 of the Statutory Powers Procedure Act, which provides that if the parties consent, a proceeding may be disposed of by a decision of the Committee without a hearing.
The Committee considered the submissions of College counsel and counsel for the Member. Upon the consent of the parties, the Committee authorizes the College to withdraw the allegations of professional misconduct and incompetence against Karl Doré set out in the Notice of Hearing, on the agreed upon terms as follows:
- That the Member undergo a successful course of instruction regarding maintaining appropriate boundaries in student-teacher relations;
- That the member draft a letter of apology to [**].; and
- That there be no publication of this resolution in the blue pages of Professionally Speaking/Pour parler profession.
Karl Doré has co-operated with the College, and by agreeing to the proposed resolution has accepted responsibility for his actions. He has successfully completed a course of instruction regarding maintaining appropriate boundaries in student-teacher relations.
The Committee concludes that the agreement is reasonable and serves and protects the public interest.
