REASONS FOR DECISION, DECISION AND ORDER(S)
This matter came on for hearing before a panel of the Discipline Committee on December 10, 2003 at the Ontario College of Teachers at Toronto.
Counsel for the College advised the Discipline Panel that the College was seeking an order from the Discipline Panel granting the College leave to withdraw the allegations set out in the Notice of Hearing against Mohamed Lemqadem. The Member consents to the withdrawal of the allegations.
Counsel advised the Panel that the Member’s wife had retracted her allegations against the Member. She was suffering from post partum depression at the time and not taking her medication. She gave evidence at the criminal trial and testified that the threats, as alleged, did not occur and that she was not afraid of her husband. On that basis the criminal charges were withdrawn.
Upon Counsel for the College advising the Committee that there is no evidence to support the allegations in this matter, and upon application of Counsel for the College to be permitted to withdraw the allegations set out in the Notice of Hearing, the Committee authorizes the College to withdraw the allegations of professional misconduct set out in the Notice of Hearing.
