The Member was not in attendance.
A Notice of Hearing, dated October 11, 2000 specifying the charges, was served on William Wayne Crowley requesting his attendance before the Discipline Committee of the Ontario College of Teachers on November 14, 2001.
On November 14, 2001, the Discipline Committee conducted a hearing into whether William Wayne Crowley was guilty of professional misconduct or incompetence as defined in sections 30(2) and (3) of the Ontario College of Teachers Act, 1996 (the "Act"). William Wayne Crowley was not in attendance at the hearing.
EVIDENCE
Both Counsel made submissions to the Committee requesting that the Notice of Hearing be withdrawn and submitted a draft Resignation and Undertaking, agreed to but not yet signed by the Member. Defence Counsel agreed to have the Member sign this document by November 21, 2001.
REASONS FOR DECISION, DECISION AND ORDERS
Based upon the submissions of both Counsel, the Discipline Committee agreed to accept the signed Resignation and Undertaking as attached to this document and accepted the request for withdrawal of the Notice of Hearing.
It is the Committee's understanding that while the general particulars of this matter will be reported in the official publication of the Ontario College of Teachers, the Member's name will not appear, since the Notice of Hearing was withdrawn.
If, for any reason, the signed Resignation and Undertaking is not returned to the College by November 22, 2001, this matter will be returned to this Discipline panel for a complete hearing.
