At the beginning of the hearing of an appeal by Constable Christy Clough (“Const. Clough”) of the Peel Regional Police Service (the “Service”) before a Panel of the Ontario Civilian Police Commission (the “Commission”) on May 20, 2014, the Commission was advised that Const. Clough had just filed a second Notice of Appeal.
After discussion with counsel for Const. Clough and the Service, and after deliberation, the Panel ordered that the two appeals by Const. Clough should be heard together.
Pursuant to Rule 3.3 of its Rules of Practice, the Commission:
(a) Orders that the two appeals filed by Const. Clough be heard together;
(b) And directs that,
i. Const. Clough deliver a single factum, brief of authorities and any supporting materials pertaining to both appeals by the end of day on June 4, 2014;
ii. The Service deliver a separate record for each appeal and a single factum, brief of authorities and any supporting materials by the end of day on June 18, 2014; and
iii. The hearing of both appeals to proceed together on Wednesday, July 9, 2014 commencing at 10:00 a.m. in the Commission’s hearing room at its offices in Toronto.
