Iusi following his plea of guilty to a charge ofdiscreditable conduct in that he had been found guilty ofassault. The finding of guilt on the assault charge resultedin a conditional discharge and probation for six months.
This appeal involves purely procedural issues whicharose because the charge was laid pursuant to the Police Actbut before the hearing the Police Act was repealed andreplaced by the Police Services Act.
Because of the procedural irregularities the penalty imposed must be quashed. I hereby substitute apenalty of the forfeiture of 20 days leave or days off.
