I. Introduction
This trial addresses the father’s Motion to Change the final order of Justice Robert Spence dated February 21, 2017, with respect to the sole issue of the father’s parenting time of the parties’ daughter, J.R-O., who is 8 years old.
Justice Spence made his order following a one day trial on February 14, 2017. The order provides that the father’s parenting time shall be at the mother’s discretion, including as to duration, frequency, and level of supervision, if any. Justice Spence ordered the mother to exercise her discretion in good faith having regard to the child’s need for the father to be involved in her life and taking into consideration the child’s age and stage of development and her best interests
The child has always had her primary residence with the mother who has decision making responsibility for the child and the father has had regular, although very limited parenting time with J.R-O. since the final order of Justice Spence.
The father asks the court to vary Justice Spence’s order to provide for a regular weekly schedule
