ORDER OF DISMISSAL
BACKGROUND
1The Applicant filed an Application with the Criminal Injuries Compensation Board (CICB).
2The CICB has been informed that the Applicant passed away on February 4, 2019.
DECISION
3Section 5 of the Compensation for Victims of Crime Act, R.S.O. 1990, c C24 (“CVCA”) provides that compensation may be awarded where a person is injured or killed by an act resulting in the commission of a crime of violence.
4There is no provision in the CVCA which permits payment of compensation to the estate of a victim where the death results from causes unrelated to the crime of violence.
5A victim’s right to payment of compensation is intended to be a personal right, which does not pass on to the estate of the victim.
6Given that the Applicant passed away, the CICB orders that this Application is dismissed as abandoned without a hearing pursuant Rule 1.3 (r) of the CICB’s Rules of Procedure.
