DECISION
Adjudicator: Catherine Bickley Date: October 18, 2024 Citation: 2024 CFSRB 121 Indexed As: SK v Highland Shores Children’s Aid Society (CYFSA s.120)
Introduction
1This is an Application filed with the Child and Family Services Review Board (“CFSRB”) under section 120 of the Child, Youth and Family Services Act, 2017, SO 2017, c.14, Sched.1 (the “Act”).
issue
2Is the Application eligible for review by the CFSRB?
RESULT
3The Application is not eligible for review by the CFSRB.
background
4The Applicant and her spouse previously had custody of their two grandchildren for several months. She is concerned with the children’s wellbeing in the care of their mother with whom they have been living since March 2024. The Applicant states that she wants ”the girls returned back to us in full permanent care” as they are in danger in their current living situation. She alleges that the Respondent is not listening to the children’s pleas to be removed from their mother’s care.
ANALYSIS
5In order for an Application under section 120 of the Act to be eligible for review by the CFSRB, the Applicant must have been seeking or receiving a service from a children’s aid society.
6The Applicant’s complaints are not about services that she herself has sought or received. Rather, they are about the Respondent’s actions (or lack of actions) with respect to her two grandchildren. As a result, she is not a service recipient and her application is not eligible for review by the CFSRB.
order
7The Application is dismissed.
confidentiality order
8Pursuant to Rules 9.3 and 9.4 of the CFSRB’s Rules of Procedure, parties and their representatives must not use, share, discuss or disclose any CFSRB documents or decisions or any other documents or information provided or used in this Application with anyone, including through the media or online. The CFSRB prohibits the use of any of this information for any purpose outside of the CFSRB’s proceedings, except with an order of the Court or the CFSRB, as appropriate.
