DECISION
Adjudicator: Catherine Bickley Date: August 16, 2022 Citation: 2022 CFSRB 40 Indexed As: ML and VL v Anishnaabe Abinoojii Family Service (CYFSA s.109)
INTRODUCTION
1This is an Application filed with the Child and Family Services Review Board (“CFSRB”) pursuant to section 109 of the *Child, Youth and Family Services Act, 2017*, SO 2017, c.14, Sched.1, (the “Act”).
BACKGROUND
2DB has lived with the Applicants continuously since August 2014. He was 11 weeks old when he came into their care.
3The Applicants state that they were told verbally on June 28, 2022 that DB would be moving from their home to his mother’s care but never received written notice of his proposed removal. They state they were later told the move was being delayed due to safety concerns.
4DB was subsequently removed from the Applicants’ care.
5In the Application, the Applicants describe themselves variously as “customary caregivers” and as “foster parents.”
6Because it was not clear from the Application whether DB was in extended society care, whether the Applicants had received appropriate notice of DB’s removal, or the exact date of DB’s removal, the CFSRB scheduled a Case Management Teleconference.
7During the August 15, 2022 Case Management Teleconference, the parties clarified that DB is not in extended society care.
ANALYSIS
8As DB is not in extended society care, the CFSRB lacks jurisdiction to review the Application.
ORDER
9The Application is dismissed.
CONFIDENTIALITY ORDER
10Pursuant to Rules 9.3 and 9.4 of the CFSRB’s Rules of Procedure parties and their representatives must not use, share, discuss or disclose any CFSRB documents or decisions or any other documents or information provided or used in this Application with anyone including through the media or on-line. The CFSRB prohibits the use of any of this information for any purpose outside of the CFSRB’s proceedings, except with an order of the Court or the CFSRB, as appropriate.
