INTRODUCTION
1P.W. (the “Applicant”) filed an application with the Child and Family Services Review Board (the “Board”) on April 30, 2008 under section 68 of the Child and Family Services Act R.S.O. 1990, c. C.11 (the “Act” or “CFSA”). The Board was asked to review complaints about the Children’s Aid Society of Hamilton (the “Society”). The Applicant was unhappy with the Internal Complaints Review Panel (“ICRP”) meeting held on April […], 2008. She alleges that the Society did not listen to key issues of concern and her daughter was not allowed to attend.
2The Applicant is the maternal grandmother of J.F., d.o.b. April […], 2003. The child was placed in the care of the Society by the mother on July […], 2005 under a Temporary Care Agreement and returned to the mother on September […], 2005. The mother again approached the Society and requested that the child be admitted into the care of the Society for the purposes of adoption. On August […], 2006, the child was placed in the care of the maternal aunt and uncle under a Court Order. The aunt and uncle informed the Society that they were not in a position to care for the child on a permanent basis and the child was re-admitted to the care of the Society on April […], 2007. The child was placed with the Applicant on an extended access visit on January […], 2008 and removed on March […], 2008 because the Applicant failed to comply with her agreement to supervise all access by the mother and work with a Parental Support Worker.
3The Applicant sent a letter of complaint dated January […], 2008 to the Society and an ICRP meeting was held on April […], 2008. The written response was sent to the Applicant in a letter dated April […], 2008.
4The Board held a hearing on August 15, 2008 in Hamilton to hear the Applicant’s complaints. The Applicant and the Society reached an agreement during this hearing.
THE FOLLOWING ORDERS ARE MADE ON CONSENT:
- The Society will convene an ICRP to hear the Applicant’s complaints as listed in Schedule A of the letter of August […], 2008 from Elizabeth Porter, the Applicant’s legal counsel.
- The Society will follow the timelines and procedures as set out under the complaint review procedure established by Regulation 494/06 made under the CFSA.
- The Society will send to the Board a copy of the written summary of the results of the ICRP meeting.
5As the Applicant has the right to review the ICRP process before the Board, there is no need for the Panel to remain seized over the implementation of the agreement.
