DISMISSAL ORDER
1An application was submitted to the Condominium Authority Tribunal (CAT) on March 6, 2026. The CAT proposed to dismiss this application under Rule 19.1 of the CAT’s Rules of Practice. The Applicant was invited to respond to the Notice. The Applicant replied but did not respond to the problems identified in the Notice.
2The application is dismissed. The dispute is about a chargeback related to repair and maintenance issues with common elements involving ice build up on balconies, as well as mould.
3Repair and maintenance issues fall under s. 89 to 92 of the Condominium Act, 1998. These sections are not under the Tribunal's jurisdiction, as set out under Ontario Regulation 179/17. The CAT does not have the legal authority to decide the issues.
ORDER
4The Tribunal orders the case dismissed.
