DISMISSAL ORDER
1The Applicant, Farouk Akyurek, filed an application with the Condominium Authority Tribunal (the “CAT”) on March 25, 2026. The CAT has reviewed the application but has not accepted the case.
2The Applicant is a tenant of the unit. The applicant confirmed to the CAT that they were filing on their own behalf and not acting as an agent for the unit owner.
3Under Rule 19.1 of the CAT’s Rules of Practice, the CAT can dismiss a case at any time if the CAT determines that that it has no legal power to hear or decide upon the dispute.
4Section 1.36 of the Condominium Act, 1998 (the “Act”) stipulates that owners, and condominium corporations can apply to the Tribunal for the resolution of disputes. The applicant is not the owner of the unit in question; they do not have standing to file an application with the Tribunal.
5As the Applicant does not have standing to continue this application, I order this application dismissed. The CAT has no authority to hear or decide a case filed by a tenant.
ORDER
6The Tribunal orders the application dismissed.
