DISMISSAL ORDER
1An application was submitted to the Condominium Authority Tribunal (CAT) on January 17, 2025. The CAT has reviewed the application and proposed to dismiss this application under Rule 19.1 of the CAT’s Rules of Practice for the following reasons:
The CAT’s jurisdiction is established by the Ontario Government in Ontario Regulation 179/17 (“O. Reg. 179/17”). The CAT does not have the legal authority to decide issues that are outside its jurisdiction.
This application was filed as a dispute about the condo corporation’s finances and board governance.
The Problem Description referred to the Reserve Fund Study and the condominium corporation’s budget regarding contracts for repairs/maintenance work.
A letter from the condo corporation was uploaded to the application. It includes reference to a leak in the building, which would result in consequent charges to the unit for investigation and repairs.
2The Applicant was provided an opportunity to update their application to relate it to matters that fall within the Tribunal’s jurisdiction. The Applicant made no changes to the application besides uploading the letter mentioned above.
3The Tribunal issued a Notice of Intent to Dismiss the application. The Applicant did not respond to the Notice.
4The case is dismissed because the CAT has no legal power to decide the issues in dispute.
ORDER
5The Application is dismissed.
