ORDER
1The Applicant made a motion to merge two records cases. The Tribunal sent notice of the motion to the Condominium Corporation’s email address rather than to the Respondent’s counsel. Consequently, the Respondent did not have an opportunity to respond, and the CAT made an order in absence of a response.
2Rule 4.1 of the Tribunal Rules establishes that the CAT may give directions or make Orders to provide a fair, focused and efficient process in each Case. Both cases are in Stage 1 – Negotiation. Both cases relate to records requests that were submitted within a short period of time. It would be most effective for the parties to consolidate all the issues in one case. The Tribunal orders the cases to be merged.
