CONSENT ORDER
1The parties to this Application agree to settle this case with a Consent Order on the terms that follow.
Background
2Elizabeth Lewis and Kirenia Lindsay are the owners of a suite in Toronto Standard Condominium Corporation No. 2823 (“TSCC 2823”). Chantelle Sulaiman is a tenant in the unit.
3TSCC 2823 brought this Application because it has received complaints that Ms. Sulaiman’s dogs are disturbing other residents because of barking. The respondents do not agree that all the complaints are warranted.
Consent Order
4The parties agree to settle this Application by way of this Consent Order on the following terms:
Ms. Sulaiman will vacate the unit no later than January 31, 2023. If that proves not possible, she will ensure that the dogs are no longer in the unit by that date. She may move out earlier than January 31, 2023.
TSCC 2823 will absorb any legal or other costs associated with this Application or events giving rise to it.
Order
5The Tribunal issues this Order on the terms set out above. This Order will close the Tribunal file.
Compliance
6If any of the Parties fails to comply with any of the terms of this order, it may be enforced through the Ontario Superior Court of Justice.
