1An application was made by Edward Frederick Murphy, the registered owner of lands described as being Lot 39, Registered Plan 352, Municipality of Dysart et al, Geographic Township of Harburn in the County of Haliburton in accordance with PIN 39149-0137 (LT), for the purpose of confirming, under the Boundaries Act, the true location on the ground of the southwest, northwest and northeast boundary of the said lands.
2In support of the application, a draft Plan of Survey with the aforementioned boundaries shown by a heavy solid line, prepared by the firm of MMM Geomatics Ontario Limited and signed by R.J. Stewart, Ontario Land Surveyor, dated March 4, 2016, was filed together with a Survey Report and supporting documentation. A notice of application, together with a copy of the draft plan was sent by registered mail to:

3Two objections were received as follows:
- An objection was received from Lawrence and Kathryn Longmore dated 26 August 2016 which was subsequently amended and dated 12 October 2016. The Longmore's are the owners of the abutting parcel being Part of Lot 16, Concession 8, Municipality of Dysart et al, Geographic Township of Harburn in the County of Haliburton in accordance with PIN 39149-0136(LT). They object to the location of the boundary between PINs 39149-0137(LT) and 39149-0136(LT) as shown on the draft Plan of Survey prepared by Mr. Stewart in support of the application.
- An objection dated 10 August 2016 was received from C. T. Strongman Surveying Limited. C. T. Strongman Surveying Limited is also objecting to the location of the boundary between PINs 39149-0137(LT) and 39149-0136(LT) as shown on the draft Plan of Survey prepared by Mr. Stewart in support of the application.
4No objections were received with respect to the other two limits under application being the limit between Lots 39 and 40, Registered Plan 352 and the limit between Lot 39 and Curry Drive, Registered Plan 352.
The Hearing
5As a result of these objections, a hearing was convened on August 14, 2017.
