DECISION
OVERVIEW
1The Assessment Review Board (the “Board”) is issuing this decision further to ID 187794 issued on April 23, 2025, Greater Sudbury (City) v Municipal Property Assessment Corporation Region 30, 2025 CanLII 37634 (ON ARB). In ID 187794, the Board ordered “that the parties shall confer and submit to the Board, within 20 days of this Interim Decision being issued, their position on the revised current value and applicable apportionments for all assessments listed in the table attached as Schedule A to this Interim Decision”.
2The parties conferred and jointly submitted revised current values and applicable apportionments for the various assessments under appeal.
ORDER
3The Board orders that the returned assessments shall be revised to reflect the “Total Value Determined” and apportionments jointly submitted by the parties in the attached Schedule A to this Decision.
4With respect to appeal 3536178, being the deemed appeal in respect of the assessment of the Nickel Rim South property (roll no. 5307-210-015-03304-0000) for the 2025 taxation year, the parties have advised the Board that Glencore Canada Corporation has filed a Request for Reconsideration of the assessment with the Municipal Property Assessment Corporation (“MPAC”). As presented as an option by the parties at a case management conference on June 17, 2025, the Board reserves its decision on appeal 3536178 for the time being. The parties are directed to provide the Board with an Expedited Board Direction Form (“EBDF”) by September 15, 2025 if there are any requests in relation to this appeal. If the Board does not receive an EBDF regarding appeal 3536178 by September 15, 2025, the Board will issue a decision that the current value of Nickel Rim South for the assessment for the 2025 taxation year is $16,270,000, apportioned as follows: $452,264 Commercial, $3,135,694 Large Industrial (Excess Land), $12,682,042 Large Industrial.
