MOTION DECISION
OVERVIEW
1The Municipal Property Assessment Corporation (“MPAC”) has brought a Motion requesting leave to file reply evidence. The Appellant consents.
Result
2The Assessment Review Board (“Board”) grants MPAC’s Motion and leave is granted to file evidence in reply to the equity issues raised by the Appellant.
ANALYSIS
Issue 1 – Should MPAC be granted to leave to file evidence in reply to the equity issues raised by the Appellant?
3MPAC has requested an amendment to the Schedule of Events that would permit it two weeks from the issue date of this decision to file its reply evidence. The Appellant consents to MPAC’s request for leave.
4The Board is satisfied that the reply evidence is necessary and appropriate in the circumstances, and MPAC has asked for a reasonable period of time to provide this evidence. The Board grants the relief requested.
ORDER
5The Board orders that the Schedule of Events be amended to grant MPAC until January 8, 2021 to serve and file its reply evidence. The Board is granting more than the two weeks requested by MPAC given the Holiday break. Following this Order being issued, the Schedule of Events will be reinstated. Following filing of the reply evidence, the matter should be set down to a Settlement Conference.
