DISPOSITION OF THE BOARD DELIVERED BY TERRY DENISON
BACKGROUND
1A telephone conference hearing (“TCC”) took place on March 24, 2015. MPAC and the City of North Bay appeared on the TCC but the Appellant, Anthony William Kozial, did not appear.
2MPAC requested that the Board make an Order requiring the Appellant to permit an inspection of the subject property by MPAC by April 30, 2015, and the Board agreed to make such an Order.
3Unfortunately the Board’s written Order was not issued before April 30, 2015.
4Consequently, this TCC was convened to deal with the status of the appeals and to make an appropriate Order.
5MPAC, the Municipality, and the Appellant all appeared at this TCC.
6MPAC repeated its request for an Order for inspection and for disclosure of the documents referred to in the Appellant’s Statement of Issues.
7The Appellant agreed to permit MPAC to inspect the property by July 31, 2015 and to deliver documents to MPAC and the City
ISSUES
8The matters to be dealt with at this TCC hearing are:
(a) Inspection and Disclosure of Rental Data, Building Expenses and Rent Roll.
(b) Timing of Statement of Responses, and
(c) Date of hearing.
DISPOSITION OF MOTION
9The Appellant is ordered to permit MPAC to inspect the property by July 31, 2015.
10By July 31, 2015, the Appellant is ordered to provide MPAC and the City with the documents and information referred to in the Statement of Issues, particularly Rental Data for 2012, 2013 and 2014 together with building expenses and rent roll.
11MPAC shall deliver its Statement of Response by August 31, 2015.
12The City, if it wishes to participate in the appeals, shall deliver a Statement of Response by August 31, 2015
13The appeals shall be set to a hearing to take place after October 1, 2015 with notice to be given to the Appellant, the City, and MPAC.
