Order of the Assessment Review Board
These matters came before the Assessment Review Board at a pre-hearing/telephone conference call event at 11:00 a.m. on September 25, 2015.
The pre-hearing was provided for in BO 137709 for the purpose of reviewing the status of the appeals.
The dates for the production motion hearing for these appeals were confirmed for November 4, and November 5, 2015 (Hearing # 593530) as set out in BO 137709.
Mr. Fleet requested a variation of BO 137709 with respect to the service requirements for motion materials on non-parties to the appeals. The parties participating in the call did not object to the request.
Mr. Fleet was directed by the Board to circulate a draft of the order he was requesting to the parties to the appeals by the end of the day on September 25, 2015.The parties were directed to advise Mr. Fleet or the Board’s case co-ordinator for the appeals of any objections to the terms of the order by the end of the day on Monday, September 28, 2015.
The Board did not receive any objections to the terms of the order as drafted by Mr. Fleet.
Mr. Milligan, Counsel for other airport tenants appeared to observe the proceedings.
This order amends BO 137709 made August 21, 2015.
The Board orders that:
- Paragraph 6 of BO -137709 is amended to provide that:
“The appellant shall be permitted to serve all other assessed persons by registered mail to the last known mailing address for the assessed persons which is to be provided by MPAC, in which case the service shall be directed to the “President, Chief Operating Officer, or Controller “”
All other provisions of BO- 137709 shall remain the same.
A copy of this order and a copy of BO 137709 shall be served by the ECC together with the motion materials on all respondents to the motion.
