IN THE MATTER OF SECTION 16 OF THE MINISTRY OF AGRICULTURE, FOOD AND RURAL AFFAIRS ACT, R.S.O. 1990, CHAPTER M.16, AS AMENDED.

AND IN THE MATTER OF: An Appeal to the Agriculture, Food and Rural Affairs Appeal Tribunal by Laplante Poultry Farms Ltd., (“LPF”) Monkland, Ontario, from a decision of Chicken Farmers of Ontario declining the request for allocation of additional kilograms of calculated based.

AND IN THE MATTER OF: the Order of the Tribunal to stay the proceedings dated April 1, 2014.

AND IN THE MATTER OF: the request of Mr. Laplante dated September 26, 2014 to resume LPF’s appeal in respect of LPF’s request for 1,082,640 kilograms of additional calculated base.

AND IN THE MATTER OF: a written hearing pursuant to Rule 13 of the Tribunal’s Rules of Procedure.

AND IN THE MATTER OF: the objection by the Association of Ontario Chicken Processors to a written hearing.

ENDORSEMENT

On October 8^th, 2014, the Tribunal issued a Notice of Pre-Hearing Conference in this matter and directed that the pre-hearing proceed by way of a written hearing.

On October 15^th, 2014, the Tribunal received an objection from the Association of Ontario Chicken Processors (“AOCP”) to holding a Pre-Hearing Conference by way of written hearing.

The AOCP seeks an oral Pre-Hearing motion.

The Tribunal has considered the AOCP’s objection and is not satisfied in these circumstances that there is good reason, at this stage, to grant AOCP’s request for the format change.

AOCP’s request is denied and the Notice of Written Pre-Hearing Conference dated the 8^th day of October 2014 continues in full force and effect.
