AND IN THE MATTER OF: An appeal to the Agriculture, Food and Rural Affairs Appeal Tribunal by Todd Suter, Blenheim, Ontario from a decision of AGRICORP concerning the adjustment of his claim for his 2004 cucumber crop under Regulation 380/97 and the Vegetable Crops Insuring Agreement.

DECISION OF THE TRIBUNAL
This appeal was scheduled to be heard in Ridgetown, Ontario on Thursday, November 10, 2005 and Friday, November 11, 2005. Prior to the commencement of the hearing, both parties asked for some time in which to attempt to resolve some of the issues. The Tribunal agreed to delay the hearing. Subsequently, Mr. Wechselmann informed the Tribunal that a settlement had been reached and a release had been signed. Mr. MacKew confirmed that the matter had been settled. The parties agreed that there was no need for a formal order to adopt the settlement agreement.
Decision and Reasons
After careful consideration of the evidence and submissions made, the Tribunal decided to dismiss the appeal for the following reasons:
The parties settled the mater and there were no outstanding issues for the Tribunal to resolve.
The Tribunal thanks the counsel to both parties for their efforts to reach an agreement.
