An Application of the Corporation of the Township of Rochester to amend the Drainage Report of E.P. Dries, P. Eng., dated March 15, 1994, on the Ruscom River, in the Township of Rochester, in the County of Essex
DECISION
This Application made by the Corporation of the Township of Rochester to amend the Report on Ruscom River, in the Township of Rochester of E.P. Dries, P. Eng., dated March 15, 1994, has been considered by the Ontario Drainage Tribunal, together with the Report dated March 15, 1994, the letter of E.P. Dries, P. Eng., dated August 23, 1995 and all other relevant materials filed:
- IT IS ORDERED THAT
the Report of E. P. Dries, P. Eng., dated March 15, 1995 on the Ruscom River be amended to provide as follows:
(a) Delete - all references to the Bed Level Crossing in the Engineer's Report dated March 15, 1995 on the Ruscom River in the S Lot 20, Con. 6, Roll #08-039;
(b) Delete the Special Benefit Assessment in the sum of $6,000.00 levied against the S½ Lot 20, Con. 6, Roll #08-039.
(c) Add - installation of graded stone rip-rap erosion protection material from Sta. 6600 to Sta. 6700 in the S Pt and NW¼ Lot 16, Con. 6, Roll #11-026.
- IT IS ORDERED THAT
here be no Order as to costs and all parties are responsible for their own costs.
Attention is drawn to s. 73 of the Drainage Act, R.S.O. 1990, c. D.17.
