IN THE MATTER OF:
An Application of the Corporation of the Township of Tilbury East to amend the Drainage Report of E.P. Dries, P. Eng., dated April 25, 1995, on the Murphy Drain - Bourdeau Culvert, in the Township of Tilbury East, in the County of Kent.
DECISION
This Application made by the Corporation of the Township of Tilbury East to amend the Report on the Murphy Drain (Bourdeau Culvert) in the Township of Tilbury East, of E.P. Dries, P. Eng., dated April 25, 1995, has been considered by the Ontario Drainage Tribunal, together with the Report dated April 24, 1995, the letter of E. P. Dries, P. Eng., dated July 21, 1995 and all other relevant materials filed;
- IT IS ORDERED THAT
the Report of E.P. Dries, P.Eng., dated April 24, 1995 on the Murphy Drain - Bourdeau Culvert, be amended to provide as follows:
(a) On Page 2 of the Report delete the section entitled "Recommendations" and substitute the following:
Recommendations:
In order to provide access to the remnant agricultural lands in the NW ½ of Lot 2, Concession 5, we recommend that a suitably sized access culvert be installed in the Murphy Drain. We recommend that the culvert consist of a 14 m length of 1200 mm diameter corrugated steel pipe having a 2 .0 mm wall thickness and a 125 mm x 25 mm corrugation profile. We recommend that graded stone rip-rap end treatment be installed on both ends of this new culvert installation. We recommend that this new culvert be installed in the westerly portion of this property where direct access will be provided from the 4-5 Concession Road onto the property. We recommend that this work be done and the related costs be assessed under the provisions of The Drainage Act.
(b) Delete the first sentence of the second paragraph on Page B-2 and substitute the following:
At the site selected, the contractor shall install and backfill a 14 m length of 1200 mm diameter corrugated steel pipe having a 2.0 mm wall thickness and a 125 mm x 25 mm corrugation profile.
(c) Delete Section 15 - culvert End Walls on Page B-2 of the Report and substitute the following:
Section 15 - Culvert End Walls
The contractor shall install graded stone rip-rap end treatment on both ends of the culvert installed under this Report. The contractor shall supply the graded stone rip-rap and synthetic filter materials as specified herein.
The contractor shall place compactible cohesive fill materials around the ends of the culvert to a minimum depth of 600 mm and shape the material to a minimum slope of 1.75 m horizontal to 1. 0 m vertical. A suitable synthetic material shal1 then be placed on these end slopes and the channel banks to a point 300 mm beyond the end of the pipe. The synthetic filter material shall meet the Class requirements of OPSS Specification 1860. The material shall be covered with a 300 mm thick layer of graded stone rip-rap. The graded stone rip-rap shall be clean, hard, durable limestone graded to a 125 mm to 225 mm nominal diameter.

there be no Order as to costs and all parties are responsible for their own costs.
