DECISION
This Application made by the Corporation of the Township of Rochester to amend the Report on the Access Bridges and Drain Enclosures for the Roadside Portion of the Kelly Drain, in the Township of Rochester of L. Zarlenga, P. Eng., dated January 11, 1994, has been considered by the Ontario Drainage Tribunal, together with the Report dated January 11, 1994, by-law #240-D-94 of the Township of Rochester and Addendum to the said Report dated February 23, 1994 and all other materials filed:
IT IS ORDERED THAT:
the Report of L. Zarlenga, P. Eng., dated January 11, 1994, on the Access Bridges and Drain Enclosures for the Roadside Portion of the Kelly Drain, in the Township of Rochester be amended to provide as follows:
All pipe material used to construct the drain enclosures and access culverts shall be corrugated plastic smooth-lined pipe (BOSS 2000 or equal).
Delete placement of culvert pipe, for William and Judith O'Neil, from Stations 16+32 to 17+67, being 135 feet of 18" diameter corrugated plastic smooth-lined pipe, and delete one 30" diameter corrugated steel pipe catchbasin at Station 17 +57.
Lot 4, being between Station 24 + 27 to 25 + 72. To be totally enclosed, requiring an additional 89 feet of 18" diameter corrugated plastic smooth-lined pipe, and 10 feet of 21" diameter corrugated plastic smooth-lined pipe and an additional 36" diameter corrugated steel pipe catchbasin at Station 25 +62.
Lot 5, being between Stations 25 + 72 to 27 + 17. Delete 99 feet of 21" diameter corrugated plastic smooth-lined pipe and delete one 36" diameter corrugated steel pipe catch water basin at Station 27 +07. Resulting in a 46-foot access bridge to be situated in the centre of the lot.
Lot 7, being between Stations 28 +62 and 30 +07. Provide an additional 10 feet of 21" diameter corrugated plastic smooth-lined pipe and an additional 36" diameter corrugated steel pipe catch water basin at Station 29 +97. Resulting in a 56-foot access bridge to be situated at the south end of the lot.
Station 30+07 to 30+53, provide an additional access bridge consisting of 46 feet of 21" diameter corrugated plastic pipe, smooth-lined, complete with quarried rock erosion protection at each end.
Delete the benefit assessment of $5,908.00 from lands owned by William and Judith O'Neil from the Construction Schedule of Assessment.
Cost of all additional work to be assessed to Rick McGuire.
IT IS ORDERED THAT
there be no Order as to costs and all parties are responsible for their own costs.
