REASONS FOR DECISION AND ORDER
A. OVERVIEW:
1This is an appeal from the removal of two animals from the appellants’ premises on December 6, 2019 pursuant to an order made under the Ontario Society for the Prevention of Cruelty to Animals Act.
2On January 27, 2020 a case conference was held, and potential hearing dates were agreed upon by all parties. Each side agreed to produce documents by February 7, 2020. The notice of hearing was sent to the parties on January 31, 2020. confirming that the hearing would take place on February 26, 2020.
3The appellants have filed no documents. Board staff have made at least five attempts to communicate with the appellants by telephone and /or email. There has been no response.
4No one appeared this morning. Additional telephone calls were attempted with no success in reaching the appellants. Nor have the appellants contacted the Board to explain their absence.
B. CONCLUSION:
5The appellants have not complied with the case conference order, have not filed any material with the Board, have not appeared today and have not communicated with the Board since the case conference. I am satisfied the they do not intend to pursue the appeal of this order.
ORDER:
6The appeal is dismissed as abandoned.
