SUPPLEMENTARY REPORT TO COUNCIL ON VIOLATION OF THE CODE OF CONDUCT FOR MEMBERS OF COUNCIL: MAYOR ROB FORD

SUMMARY
The Integrity Commissioner is required by the Code of Conduct Complaint Protocol for Members of Council (“Complaint Protocol”) to report to City Council on investigations of formal complaints where it has been determined that there has been a violation of the Code of Conduct for Members of Council (“Code of Conduct”) by a member of Council.
Item CC51.3 is such a report on Council’s agenda for its meeting of May 6 and 7, 2014.
On April 30, 2014, Mayor Ford announced he will be taking a leave of absence. The Integrity Commissioner recommends that Item CC51.3 be deferred until such time as Mayor Ford returns.
RECOMMENDATIONS
The Integrity Commissioner recommends that City Council defer consideration of Item CC51.3.
FINANCIAL IMPACT
This supplementary report will have no financial impact on the City of Toronto.
ISSUE BACKGROUND
On November 5, 2013, Councillor Ainslie complained that Mayor Ford violated three provisions of the Code of Conduct for Members of Council by making robocalls to residents of Ward 43 following the October meeting of City Council.
By report dated April 28, 2014 the Integrity Commissioner made a finding that Mayor Ford had breached the Code of Conduct and recommended that City Council request an apology from Mayor Ford. In such circumstances, members have the ability to speak to a report of this kind before Council.
On May 1, 2014, Mayor Ford filed notice that he is taking a leave of absence.
The Integrity Commissioner recommends therefore, that City Council defer its consideration of the report pending Mayor Ford's return.
