The appellant argued that the sentencing judge failed to properly consider that authorities had removed him from medication that was helpful to him, which contributed to his anti-social attitude culminating in the murder.
The Court of Appeal found that the sentencing judge expressly addressed this issue and concluded that the mitigating factors were greatly outweighed by numerous and serious aggravating factors.
The appeal was dismissed.
