The appellant police officer appealed his conviction for neglect of duty under the Police Act.

The Ontario Civilian Police Commission dismissed the appeal, finding that the appellant failed to properly transfer responsibility for the investigation and had a duty to follow the matter more thoroughly despite being on his day off.
