The mother brought a status review application seeking the return of her two children, who had previously been made Crown Wards without access due to her severe substance abuse and domestic violence issues.

At trial, she amended her request to supervised access.

The court found that the mother and her partner had made significant progress in their rehabilitation, including two years of sobriety through a methadone program and extensive counselling.

Concluding that the circumstances had changed significantly and that access would be beneficial and meaningful without impairing adoption opportunities, the court granted the mother supervised access for six months subject to strict conditions.

The applicant brought motions for temporary specified access and to find the respondent in contempt for failing to comply with a prior court order to list and sell their jointly owned home.

The access motion was resolved on consent.

On the contempt motion, the court found that the respondent deliberately and wilfully frustrated the listing obligation.

The court found the respondent in contempt, ordered her to vacate the home by a specified date, and imposed a $200 per day penalty for failure to comply, with police enforcement authorized if necessary.
