On a motion pending an appeal from a Consent and Capacity Board decision, the respondents sought interim relief authorizing electro-convulsive therapy.
The court accepted uncontroverted medical evidence that the proposed treatment had historically improved the appellant’s condition and that, absent treatment, her health would continue to decline, with ongoing risks of self-harm and harm to caregivers.
The court recognized that forcible treatment is a serious infringement of personal autonomy and bodily integrity, but found the statutory criteria under s. 19(2) of the Health Care Consent Act were met.
Interim treatment was authorized pending appeal.
