Human rights application dismissed for lack of jurisdiction over workplace harassment occurring entirely in Alberta.
The applicant, an Ontario-based employee, filed a human rights application alleging discrimination and harassment by co-workers during a company training event in Alberta.
The respondents brought a request to dismiss the application on the basis that the Human Rights Tribunal of Ontario lacked jurisdiction over events that occurred in Alberta involving Alberta-based co-workers.
The Tribunal found that the 'employees' subject to duties under the Human Rights Code do not include individual respondents who reside and work in Alberta when the alleged conduct occurred entirely in Alberta.
As there were no independent allegations against the employer regarding conduct in Ontario, the application was dismissed for lack of jurisdiction.
