The applicant union applied for certification to represent employees currently represented by the intervenor union.

The Board dismissed the objection, noting that the intervenor had signed consent and waiver forms after the vote and failed to establish that any agreement for a re-vote had been made.
The Board upheld the vote results and directed that a certificate issue to the applicant.
