Furthermore, the plaintiffs lacked standing to sue the agent directly for property damage without first seeking recourse against the vendor bank, which held the property in trust prior to closing.
Despite dismissing the claims, the court strongly condemned the agent's deceitful conduct and directed that the decision be forwarded to the Real Estate Council of Ontario.
