This is my Final Order disposing of the one remaining issue which was initially addressed in Interim Order M-838. In that order, I directed the Metropolitan Toronto Police Services Board (the Police) to provide representations on the factors it considered in exercising its discretion to refuse to disclose part of a 911 tape and Records 21 and 46-57 to the requester pursuant to section 38(a) of the Municipal Freedom of Information and Protection of Privacy Act (the Act).
I have received the representations of the Police and have carefully considered them. In the circumstances of this appeal, I am satisfied that the Police have exercised their discretion in accordance with established legal principles. Therefore, it is my view that the decision of the Police should not be disturbed on appeal.
ORDER:
I uphold the decision of the Police.
