DECISION
Adjudicator: Yasmeena Mohamed
Date: August 2, 2017
Citation: 2017 HRTO 986
Indexed as: Piatowski v. Unifor Local 199
1This is an Application filed under the Human Rights Code, R.S.O. 1990, c. H.19, as amended, dated March 17, 2017, alleging discrimination in membership in a vocational association on the basis of disability and reprisal or threat of reprisal.
2On June 22, 2017, the Human Rights Tribunal of Ontario (“Tribunal”) issued a Notice of Intent to Dismiss (“NOID”) the Application, on the basis that the Application appeared to be outside the Tribunal’s jurisdiction to decide.
3The applicant was directed to respond to the issue raised in the NOID by no later than July 22, 2017.
4The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason.
5The applicant has not responded to the NOID and the time for doing so has now expired.
6The Tribunal records indicate that the NOID was sent to the applicant by regular mail to the address identified in the Application. As of the date of this Decision, the Tribunal has not received any “returned mail” to indicate that the NOID was not delivered and/or received by the applicant.
7In the circumstances, the applicant is deemed to have abandoned the Application.
8The Application is dismissed.
Dated at Toronto, this 2nd day of August, 2017.
