Introduction
1This is an Application is filed under the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”), dated April 24, 2017, alleging discrimination in membership in a vocational association on the basis of disability.
2On June 23, 2017, the Human Rights Tribunal of Ontario (Tribunal) issued a Notice of Intent to Dismiss (“NOID”) the Application, on the basis that the Application appeared to be outside the Tribunal’s jurisdiction to decide.
3The applicant was directed to respond to the issues raised in the NOID by no later than July 24, 2017.
4The NOID advised the applicant that failure to respond to the NOID may be considered an abandonment of the Application and it might be dismissed for that reason.
5The applicant has not responded to the NOID and the time for doing so has now expired.
6The Tribunal records indicate that the NOID was sent to the applicant by regular-mail to the address identified in the Application. As of the date of this Decision, the Tribunal has not received any “returned mail” to indicate that the NOID was not delivered and/or received by the applicant.
7In the circumstances, the applicant is deemed to have abandoned the Application.
8The Application is dismissed.
