BETWEEN:
Zahra Imani Applicant
-and-
St. Michael's Hospital Respondent
DECISION
Adjudicator: Jo-Anne Pickel Date: July 27, 2017 Citation: 2017 HRTO 950 Indexed as: Imani v. St. Michael's Hospital
1The applicant filed this Application alleging that the respondent discriminated against her because of disability contrary to the Human Rights Code, R.S.O. 1990, c. H. 19, as amended (the "Code"). Specifically, the applicant alleged improper care by the respondent hospital.
2The respondent filed a Response in which it denied the applicant's allegations. It also filed a Request for Summary Hearing in which it requested that the Tribunal dismiss the Application on the basis that it has no reasonable prospect of success under the Code.
3The applicant did not file a Reply to the Response, nor did she file a Response to the respondent's Request for a Summary Hearing.
4By Case Assessment Direction ("CAD") dated June 19, 2017, the Tribunal directed the applicant to file with the Tribunal her position with respect to the Response and the Request for Summary Hearing no later than June 21, 2017. The Tribunal advised the applicant that it might dismiss her Application as abandoned if she failed to do so.
5The applicant has not responded to the CAD and the time for doing so has passed.
Order
6In the above circumstances, the Application is dismissed as abandoned.
Dated at Toronto, this 27th day of July, 2017.
