Respondent
DECISION
Adjudicator: Eban Bayefsky
Indexed as: Perez-Jimenez v. Toronto Airport Marriott Hotel
1The applicant filed an Application under s. 34 of the Human Rights Code, R.S.O. 1990, c. H.19, as amended, on April 5, 2017.
2On June 8, 2017, the respondent asked the Tribunal to dismiss the Application on the basis that the applicant had signed a full and final release with respect to the same issues in dispute. On June 16, 2017, the Registrar directed the applicant to make submissions on the matter by July 7, 2017. The Registrar warned that failure to provide the requested submissions would result in the Tribunal making a decision based solely on the information in the Application and might result in the Tribunal dismissing the Application as abandoned.
3The Registrar’s June 16, 2017 letter was sent by email to counsel for the applicant.
4Neither the applicant nor his counsel has responded to the email and the time to do so has now passed.
5In the circumstances, the applicant is deemed to have abandoned the Application and the Application is dismissed.
Dated at Toronto, this 20th day of July, 2017.
