DECISION
Adjudicator: Jo-Anne Pickel Date: December 22, 2017 Citation: 2017 HRTO 1701 Indexed as: Allen-Richards v. Toronto District School Board
1The applicant filed an Application alleging that the respondents discriminated against her contrary to the Human Rights Code, R.S.O. 1990, c. H. 19, as amended.
2On June 6, 2017, the Tribunal sent the applicant a Notice of Intent to Dismiss (“NOID”) the Application on the basis that it appeared to be filed more than one year after the last incident of alleged discrimination. The Tribunal advised the applicant that if she did not respond to the NOID, the Tribunal might dismiss her Application as abandoned. The Tribunal sent the NOID to the applicant by regular mail. On August 18, 2017, the Tribunal sent the applicant a copy of the NOID by email. The applicant requested an extension of time to respond to the NOID. The Tribunal granted the applicant an extension until September 8, 2017 to respond to the NOID.
3The applicant did not respond to the NOID and the time for doing so has passed.
4In the circumstances, the applicant is deemed to have abandoned the Application.
ORDER
