1This is an Application filed on September 9, 2016 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”).
2On September 18, 2017 the respondent filed a Request for Summary Hearing (“Request”) seeking the dismissal of the Application because there is no reasonable prospect that it will succeed. The applicant has not filed a Response (Form 11) to the Request and the time for doing so has passed.
3In a Case Assessment Direction issued on November 7, 2017 the applicant was directed to deliver and file a Response (Form 11) addressing the issue raised in the respondent’s Request within 14 days of the date of the Direction, failing which this Application may be dismissed as abandoned.
4The Case Assessment Direction was sent by regular mail and email to the addressed provided by the applicant. There is no indication that it was not received.
[6] In the circumstances it appears that the applicant has abandoned the Application and it is dismissed.
